Driver of Fatal Huntsville Accident Denies Claims

Huntsville car accident - Martinson & Beason, P.C.In May, our community was shaken by the death of a ten-year-old in a tragic car accident. A man, later identified as Gunner Joseph Scarano, was driving a black truck and travelling north on Bailey Cove Road when he hit three vehicles and a motorcycle. No injuries were reported from this accident. Scarano then continued to drive until he caused another accident at the Weatherly Road intersection. The people surveyed admitted to eating, drinking beverages, speeding, driving while tired, and using a cell phone while behind the wheel. The study demonstrates a clear disconnect between drivers’ perception of their driving abilities and their actual driving abilities. This disconnect makes it difficult for a driver to honestly examine their driving behavior and make corrections, which is perhaps why more than 3,000 people were killed and over 416,000 were injured in crashes involving distracted driving in 2010—despite the ample evidence available to the public showing the dangers of distracted driving.

What To Do If You Have a Slip and Fall in Alabama

Slip and Fall AccidentA slip and fall or trip and fall accident comes within an area of the law known as premises liability. Under Alabama law, a premises owner has a duty to keep their premises in a reasonably safe condition for a business invitee. The plaintiff or injured party has the burden of proof in slip and fall case to establish that the premises owner/operator knew or should have known of the dangerous condition on their property that caused the person to fall. This often is a tough burden to meet. However, this can be established in a variety of ways: 1. Does the premises owner have a policy and procedure whereby they monitor their premises; 2. If the fall was caused by a substance, was there such a large amount that they should have noticed it?; 3. If the fall was caused by a defect in the premises the premises owner is presumed to have notice and knowledge of the condition; and 4. The Importance of Registering Your New Products

With the holiday season in full swing, most of us will be out shopping for all types of new products from electronic devices to home improvement items. When your tearing through the wrapping paper and boxes before you throw away that Product Registration card, STOP!! The process of filling out the registration card seems like a hassle when all you want to do is starting enjoying and using your new product; however, that little card can prevent a serious injury and/or save someone's life. I was just recently reminded of how important registering a product is. I was recently retained by a client who was severely injured when a defective product exploded in his face, causing him to lose an eye. Alabama Graduated Driver License Law

As of July 2010, Alabama now has new driver's license laws that apply to drivers' ages 15 and 16. This law dramatically changes the rules for new drivers and should be reviewed by all new drivers and their parents/guardians. Here is a summary of the new law: Stage I - Learner's Permit • Must be age 15 or older. • Must pass a written examination. • Can only drive when accompanied by a parent, legal guardian or licensed driver who is age 21 or older and occupying the seat beside the driver. Stage II - Restricted License • Must be age 16 or older.
